Outreau Case verdict unfounded : Marécaux daughter's was raped (hymen evidence)

One of the main arguments of the defense lawyers, who assure that the accused are innocent, is that one of the little victims was declared a virgin by a gynecological doctor. This expertise must be qualified because science shows that the absence of physical after-effects does not mean the absence of rape.

Gail Hornor, a pediatric nurse practitioner and child maltreatment researcher at Nationwide Children’s Hospital in Columbus, Ohio, explains this in an article in the Georgia Health News. She explains that in many cases, the signs that did exist have already disappeared by the time of the exam.

Jordan Greenbaum, a forensic pathologist at Children’s Healthcare of Atlanta, explains that an average, normal hymen has a small opening in it already. Because the hymen is behind the labia minora, a pair of inner skin flaps that surround vaginal opening, it is not always touched when penetration occurs.

“There can be penetration of the labia [minora] without there being penetration of the hymen,” Greenbaum says. “And people tend to only think about penetration but forget about other forms of sexual abuse such as fondling.”

So what would have happened if the Marécaux' daughter had not been unscientifically declared virgin, and so liar ?

The outcome of the trial would certainly have been different when we see the importance of this element in the statements of Odile Mondileu-Héderer in the Netflix documentary...

Indeed it would have forced the participants in the hearing to realize that the case did not rest solely on Myriam Badaoui and the Delay children.
