First of all, on behalf of the Guianese Human Rights Organization (GHRO), I would like to warmly thank the Foundation « Nos Ke Boneiru Bèk Punto ! » Through its President M James Finies, and Ms. Davika Bissessar, President of the « We Dare To Care " Foundation, for their kind invitation to this very encouraging initiative under the high patronage of Dr Carlyle Corbin, as it is a tremendous world-wide freedom call.
Our Ancestors are watching us !
Given the Native American question that’s been tottally crossed out, and the slave Trade that populated the Americas. The awareness of our fundamental rights was directly transmitted to us by the resistance of the great Amerindian struggles and the Marronage.
Thus, in our day, Guiana owes to its indigenous peoples much of its activist vitality to repel the multiscalar permanent assaults of the French assimilation barbarity. Its central power continoulsy trying to destroy our composite plurinationality since the 1946 legalizing colonization law.
More than four centuries of subjection, of French presence who owns the land and to whom belongs the Right, without us being able to obtain the smallest part of the 35.000 square miles private domain of the State. France has never given us access to land yet suffered from the blood spill of its "original" peoples, and / or the uprooting of the Former Country, for the Afro-ascendant heirs.
The denial of Guianese identity is politically programmed under all successive "metropolitan" governments. You can have colonialism by pouring money in the territory, giving it a not neglectable democracy, but above all you (the people) get the state contempt.
To respond to the question of the Reparations in Guiana against the French judicial system today, the Gguianese International Movement for Reparations (MIR-Guyane) reminds us that the question of Reparations comes from the point of view of inheritance.
The problem is that this legacy of values owned by our ancestors, is today put at the service of the French colonialist state. This heritage presents itself on the one hand, under the falsification of History.
In order to dominate a people, it is necessary to deprive it of its History, and consequently the Guianese, or the inhabitants of Guiana, the persons of African Ancestors are deprived of their History and are lodged at the rank of those who have no History.
The second aspect of the Heritage issue, is the aspect of economic inheritance. When you are dispossessed of your land because you are suffering Deportation, you were on land in Africa, this land dispossession continues for the land developed by our ancestors, and which allowed the enrichment of Europe. Its all about dispossessions with colonial legitimacy.
The third aspect, is the theory of confrontation that is developed, according to which the Guianese people are confused with the French people, and that, therefore, if we are confused, there is no repair that would become legitimate. But the realities are that the Guianese people evolve, in Guiana, on totally different levels than those of European and French nationals. Because we, we should demonstrate our humanity while they have this humanity quite naturally, because they have all the directorial positions of the state administrations in the country etc., it is They who manage everything !
If we refer to the positive responses to Reparations by the Caribbean countries, these answers are mainly related to the fact that these countries are independent countries. While in Guiana, it is difficult to accept that French justice, the justice of a western state can recognize the right to Reparations, because we are located on the French plane, which is negation of our identity.
The question of Reparation is consubstantial/ intrisic with the Decolonization question, and the access of the Guianese people to its sovereignty.
So today, the question is clearly raised, particularly in Martinique and Guadeloupe.
In French Guiana, in legal terms, there is still no referral to the French court on this issue, because it’s a matter of activist means that must be given, so as to find lawyers who are able to be in conflict with the state, because it’s also about being commited lawyers.
Even more broadly, where the Guianese attorney stops, to not end up in prison, that's where begins the Combat of Law against the vigor of French foreign law without rights or title in Guiana. If in Martinique and Guadeloupe the legal confrontation with the State has already taken place, it is because Martinique and Guadeloupe have activist lawyers who are able to enter into direct conflict with the French state.
This is not openly said in Guiana, but the question is clearly not yet resolved. However, as a recent example of restorative justice, we note that during this summer, in Great Britain, the Scotish, Glasgow University will pay the University of the West Indies 20 million Pounds to fund a joint centre for developpement research as Reparations to buy back its historical ties to the transatlantic slave trade. As a matter of fact : Without Reparations then, Crime Pays !
Endangered Autonomy for Bonairians / Prohibited Autonomy for Guianese
Two times, in the current Guiana history, on september 1958, and december 2010, France organized an internal bilateral referenda in order to make the people remaining, for sure, under its full administering power. Two times as a result, our people’s domination consent didn’t reflect at all some kind of self-determination. The march-april 2017 pacific uprising of the population fed up with neocolonialism and exploitation was a spontaneous nation birth will. Effective self determination through local laws-making government is now claimed by the « Projet Guyane » defended by the Guianese Front for a Statutory Change.
As you know, at the end of World War II, France metaphysically integrates Guiana by a legal subterfuge (without a referenda), admitted by the United Nations…
1958 is the year of the very first guianese resolved attempt to obtain a « Special Status » from the « metropolis ».
"Independence, we'll see ! Autonomy, Never ! This sentence pronouced by the General de Gaulle in response to the express claim of the Guianese people via his deputy, Justin Catayée, persists through time as a well intagrated colonialist reflex.
Indeed, it’s a legacy of coercicion of a democratic expression, which is repeatedly practiced from generation to generation among the senior officials of the great interests of the French State. Moreover, tragedy of political destiny, Justin Catayée and the General staff of the Antillo-Guianese Front for Autonomy are physically sacrificed in the mysterious june 1962 Air France Boeing crash on Morne Deshayes in Guadeloupe ...
Closer to us, 2010 was an alleged referendum which was not one because it was directly framed by the French Head of state at the time Nicolas Sarkozy, and was dismissed by 71% of registered voters. The referenda point, for an over-determined population, was to choose between status quo, and some sort of indistinct autonomy, which, in the given dependency conditions at the time, had been perceived as scary.
In March-April 2017, Rediscovering the path of its History by passing to the act of general strike at the call of the independantist Central Trade Union of the Guianese Workers (UTG), 50,000 people out of a population of 300,000 exceed the conditions of assimilation, in action throughout the country, and nail to the ground the Ariane V European launch vehicle of the military-space city of Kourou.
On 21st april after 37 days of intense popular mobilizations, the Guiana Agreements are signed in high struggle between the French State and the 400 associations of the Kolektif Pou Lagwiyann Dékolé (KPLD). A year and a half later, on 27 November 2018, the Congress of Elected Representatives of Guiana referred to the Metropolitan Government a draft statutory change under Article 72 of the French Constitution.
With rare exceptions, the alienation, the betrayal of the Guyanese elites in political representation at the orders of Paris, is a real calamity that prevents us from getting out of this political stalemate. Today the level of autonomy and skills desired, is clearly specified, and detailed in « The Projet Guyane 2018 » of the Guyanese Front for a Statutory Change.
Based on three Pilars : Societal, Economic and Governance skills ; it states in its preamble that :
“The colonial regime, the departementalisation, and then the decentralization laws have shown the limits of public policies for the development of our territory (…)
(…) [claiming] consideration of the aspiration of the Guianese people to control their institutions, in order to protect their lifestyles, their identity, their languages [mother tongues] etc.
The central government's response to the Guianese Front's Project came on last August 28, when president MACRON, reorganized by decree, the missions of the services of the State, by significantly increasing the powers and attributions of the prefect of Guiana (today assisted by a single sub-prefect) , by adding 4 sub-prefects, responsible for security among other general managers of the decentralized services of the State ... to which may be added one or more other prefects sended from Paris in charge of mission.
It is a real Resumption in Hand of the territory that will enter into force from next 1st January 2020.
Rather willing to align, with the slow calendar of constitutional review initiated, by the President for France, the current President of the deliberative Assembly of Guiana, Mr Rodolphe Alexandre tends to obstruct the process of popular consultation aimed at adopting the “Guiana Project” of statutory development provided for in the provisions of the Guiana Agreements.
Which has the effect of forcing the members of the Guianese Front For a Statutory Change to block access to the public building of the Territorial Collectivity of Guiana on this November 25 in Cayenne, so that Mr Alexandre convenes the Congress of Elected Representatives to pronounce on the Guiana Project. In this regard, the plenary assembly meeting on December 18th promises to be agitated.
On a daily basis, the Guianese are fighting to have a piece of land against a quantity of deconcentrated administrations of the state such as the National Forest Office.
Every day, prohibitions of ancestral cultural customary uses such as harvesting turtle eggs, clearing trees for giblets, the collection of palm leaves for our traditional bioclimatic habitat etc. Fall under the constant blows of metropolitan laws, decrees, ministerial and / or prefectural circulars resulting from European directives.
To conclude, the GHRO appeals to the political courage and historical dignity of all local elected representatives, present and future, of the Territorial Colletivity of Guiana, and to the Guianese parliamentarians in Paris, to intercede with the United Nations to assert our inalienable right to self-determination as expressed in the Projet Guyane defended by the people through the Guianese Front for a Statutory Change following the peaceful demonstrations of March-April 2017.
We urge Paris to recognize the fundamental rights of our original peoples by finally ratifying the ILO Convention 169 on the rights of indigenous peoples.
Finally, the opportunity offered by the Bonaire International Symposium implies that all the States of the Caribbean and South America, sensitive to our distress call, strongly support the Guianese people request to the UN through its Committee of the 24 to urge France to admit the Projet Guyane, and for our re-registration on the list of non-autonomous countries.
A plurinational Guiana (populated by more than 200,000 people of Afro-Ancestry, and more than 12,000 Native Americans) that all must recognize as their only homeland, marking the 21st century.
Building on the 3rd UN Decade of (Unfinished) Elimination of Colonialism, which already calls for a Fourth, to remove residual colonial peoples from their situation, as well as on the theme of the International Decade (2015-2024) proclaimed by the General Assembly : “For people of African descent : Recognition, Justice and Development”. We demand that the French State implements the Guyana Project, that will be worth as first stage of the Reparations of its colonialism.
